Right of withdrawal

Right of withdrawal (Directive 2011/83/EU, ratified in Italy with Legislative Decree 21 February 2014, N. 21)

If the customer is a consumer (i.e. a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating a reference number in the order form on the shop.marinasystems.it website VAT), has the right to withdraw from the purchase contract, if this has been stipulated and concluded remotely, for any reason, without the need to provide explanations and without any penalty.
The law applies to products purchased in their entirety, it is not possible to exercise the withdrawal only on part of the goods purchased in the same transaction and provides for the reimbursement of the entire amount of the transaction (including outward transport costs).

To exercise the right of withdrawal, the customer must send, within 14 days from the date of delivery of the goods, a communication by registered letter with return receipt to Marina Systems srl Via F. Baracca, 3 – 24034 Cisano Bergamasco (Bg ). This communication must contain the buyer's name and surname, no. order, no. invoice and date of purchase.

The purchased goods must be in the same conditions as received, with the original packaging (intact and complete in all their parts as they are considered integral parts of the goods), with the manuals, accessories, parts, keys and everything that was endowment, without any lack.

The consumer is possibly and solely responsible for the decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
In the case in which the goods are evidently used due to the use made, such as to undergo a consequent commercial devaluation upon its re-marketing in the state of "used product", a possible reduction in value will be carried out. The same thing also in the case of lack of the original packaging or its non-integrity, such as to require its repurchase from the manufacturer and its replacement.
To limit damage to the original packaging, we suggest, when necessary, to insert it in a second box, avoiding in all cases the affixing of labels or adhesive tapes directly on the original packaging of the product.

The customer will forward the product to the Marina Systems srl warehouse via his own forwarder, Via F. Baracca, 3 - 24034 Cisano Bergamasco (Bg), within 14 days of the notice of withdrawal. The return shipping costs are charged to the customer.

The goods, until the certificate of receipt in our warehouse, travel under your responsibility, it is therefore advisable to insure the shipment against theft, loss or damage in transport (for which we assume no responsibility in the return shipping).

Once we have received the goods, we will reimburse the customer for the full amount of the transaction (subject to the limitations referred to in the previous points and excluding any ancillary costs including cash on delivery costs in the event that the customer has used this service), within 14 days of the return of the goods, using, except in special cases, the same payment method chosen by the customer.

WITHDRAWAL OF THE SUPPLIER

 Marina Systems srl has the right to withdraw from the sales agreement within 30 days from the date of the order by providing the customer with a simple reasoned communication

a) if it were unable to process the requested order due to the unavailability, even temporary, of the ordered product (pursuant to article 54, paragraph 2 of Legislative Decree 206/05).
b) if there are reasons such as to make the transaction not executable under the normal conditions and procedures envisaged.

In such cases, the customer will only be entitled to a refund of any amount already paid.
